Q: Does a real estate professional need permission to advertise for sale or sold properties?
A: The Real Estate Council of Ontario (RECO) enforces advertising regulations to make sure real estate professionals uphold the integrity of the profession. The regulations also include safeguards designed to protect the privacy of home buyers and sellers when it comes to advertising properties that are for sale and/or have been sold.
Essentially, if you’re selling, or have just bought a home, written consent is required for the brokerage to advertise your property. If you’re selling, the listing agreement will likely contain a clause that gives them permission to advertise the property.
When your house sells, but before ownership is transferred to the buyer, the same consent clause would allow the brokerage to advertise the sale.
